These Terms of Service ("Terms") govern your access to and use of the osdp.dev website, the Osprio hardware and software products, and any related services (collectively, "Services") provided by osdp.dev ("we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Product availability, specifications, and pricing are subject to change. We will make reasonable efforts to communicate significant changes in advance.
Some Services require you to provide an email address to join a waitlist or access early releases. You agree to provide accurate information and to keep it up to date. You are responsible for all activity associated with your registration. We reserve the right to remove any registration that we believe violates these Terms or is used fraudulently.

Our products incorporate LibOSDP and other open-source software. These components are distributed under their respective open-source licences. Nothing in these Terms restricts your rights under those licences. Copies of applicable licences are provided with the relevant products or available at github.com/goToMain/libosdp.
All content on this website — including text, images, product names, logo marks, and design — is owned by or licensed to osdp.dev and protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works from any part of the website without our prior written permission, except as expressly permitted by applicable law.
The Osprio name and related product names are trademarks of osdp.dev. Nothing in these Terms grants you any licence to use our trademarks.
Professional services engagements are governed by a separate written Statement of Work (SOW) or consulting agreement agreed between the parties before work begins. In the absence of a separate agreement, work-product created by osdp.dev for a client is assigned to the client upon full payment of all outstanding invoices. osdp.dev retains the right to reuse general methods, know-how, and tools developed during an engagement.
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including without limitation implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. Hardware products are warranted separately under the terms provided with each product shipment.
To the fullest extent permitted by applicable law, osdp.dev shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising from these Terms or the Services shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred US dollars (USD 100).
Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which osdp.dev is registered, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or, where arbitration is not enforceable, to the competent courts of the governing jurisdiction.
We reserve the right to modify these Terms at any time. We will update the "Last updated" date when we do. If changes are material, we will make reasonable efforts to notify registered users. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
